The class action lawsuit, In re: Blue Cross Blue Shield Antitrust Litigation, addresses Provider Plaintiffs’ claim that the Settling Defendants violated antitrust laws by illegally dividing the United States into "Service Areas" and agreeing not to compete in those areas. Provider Plaintiffs also claim that the Settling Defendants fixed prices for services provided.

FPMA has fielded numerous requests for advice about this issue. Below is a statement provided by FPMA General Counsel, Jason D. Winn, PA.

The FPMA is not in a position to provide legal guidance to any one member regarding their ability or inability to file a claim in this settlement. As always, each member would be best served by consulting a healthcare attorney, and in this case, one well-versed in anti-trust litigation, to review their individual situation. BCBS has a Provider Settlement website available to provide updated information regarding claims, which includes FAQ’s and provides a means to contact BCBS directly. While the deadline to file claims (July 29, 2025) has passed, a claim can still be filed and will be designated as “late” upon arrival and subject to the Settlement Administrator.
